TERMS OF PROFILE OPENING AND USE ON THE REAL ESTATE MANAGEMENT PLATFORM IMPLEMENTED BY AMERIABANK CJSC
Approved by Management Board resolution #02/11/22 dated January 21, 2022. Current edition approved by resolution № 02/30/26 as of March 03, 2026, effective from the date specified below.
1. General Provisions
1.1. These terms (hereinafter - the Terms) set out the terms and conditions of user registration, service, and use by customers of myhome.am platform (hereinafter - the Platform) of Ameriabank CJSC (hereinafter - the Bank), as well as the legal relationships related to the use of services through the Platform.
1.2. For the purposes of the Terms, a “customer” or “you” means an individual registering or maintaining a user on the Platform.
1.3. By filling in the data required for registering a user and clicking the respective button, you become a registered user (hereinafter - the User) and agree to act in accordance with the Terms.
2. Services Provided to Registered Users
2.1. Once you’ve registered a user on the Platform, you will be able to make use of the following services:
2.1.1. Credit services:
2.1.1.1 Creditworthiness assessment;
2.1.1.2. Submitting a loan application for purchase of real estate, including remote identification, signing loan agreements, etc.
2.1.2. Services related to sale and/or lease of real estate:
2.1.2.1 Submitting an application for publication of an announcement for sale and/or lease of real estate;
2.1.2.2 Receiving inquiries from other persons regarding the announcement published by the customer.
2.1.3. Services related to purchase and/or rent of real estate:
2.1.3.1. Viewing advertisements on real estate available for sale and/or rent;
2.1.3.2. Booking an advertisement, receiving a notification about cancellation of booking by another person;
2.1.3.3. Searching for advertisements that match the Customer’s preference;
2.1.3.4. Sending an inquiry to the seller who published the advertisement.
2.1.4. Other available services:
2.1.4.1. Viewing real estate properties automatically displayed on the customer’s profile, including details of those properties (applicable to identified users);
2.1.4.2. Other services.
2.2. In cases specified by the Bank, obtaining a loan through the Platform may require identification and signing of loan agreements on the Bank’s premises.
3. Registering a User on the Platform
3.1. You can register a user on the Platform:
3.1.1. By visiting the Platform, in which case you should fill in your personal and contact data required by the Platform and set a password meeting the minimum security requirements of the Bank.
3.1.2. By logging into the Bank’s MyAmeria remote service system and visiting the Platform from its relevant section, in which case the user is automatically created by the Bank and the password must be set by you, following the steps specified in the message sent to your e-mail address. This option to register a user on the Platform is available if you have the appropriate status (level) of using MyAmeria remote service system.
3.2. We will communicate with you in connection with the actions made on the Platform through the email address and mobile number specified by you. Please be careful because if you enter wrong data or contact details that belong to another person, the information about you or addressed to you may become available to third parties. In such cases, the Bank will not be held liable.
3.3. To register a user on the Platform, as well as use the Bank’s services through the Platform, the Customer’s contact data may be verified to confirm that those contact data are used by the Customer. The Bank may establish a deadline for contact data verification, upon expiry whereof the Customer receives the relevant notification on their user profile on the Platform regarding the necessity to verify the contact data once again.
3.4. By clicking on or tapping “Next”, “Confirm” or “Submit to the Bank” buttons on the Platform, you confirm the respective applications and submit them electronically thus confirming your consent and intention to be bound by such transactions. Your consent and your intention apply, in particular, to all those actions and records that you make on the Platform.
4. Use of the Platform
4.1. You can log in to your user profile on the Platform:
4.1.1. By visiting the Platform, in which case you should enter the username and password for the Platform;
4.1.2. By logging into the Bank’s MyAmeria remote service system and automatically accessing your user profile on the Platform from its relevant section. This option to log in to the Platform is available if you have the appropriate status (level) of using MyAmeria remote service system.
4.2. If you forget the password or need to reset it, once the relevant instruction is received, you should follow the actions specified in the message sent to your e-mail address.
4.3. On the Platform, you can raise the level of your user identification by undergoing full identification, for which you should provide the necessary personal and contact data required by the Platform and follow the steps specified by the Platform for identification. In the scope of certain services on the Platform, additional identification may be required for provision of such services.
4.4. You are liable for the authenticity, completeness and accuracy of your actions on the Platform and their consequences. We will treat any action you perform on the Platform as direct and true expression of your will. We will not be held liable for any misprints and other mistakes made by you.
4.5. By registering on the Platform, you agree to:
4.5.1. keep confidential the information required for signing into your user profile, not disclose the passwords and other data required for registering a user on the Platform and logging into the Platform or otherwise make them known to third parties, and not perform any actions which may lead to such information becoming accessible to third parties;
4.5.2. promptly give notice to the Bank of any unauthorized login into your user profile or such attempt and/or any unauthorized transaction through your user profile or such attempt;
4.5.3. reimburse all the costs, losses and damages that the Bank may incur as a result of non-performance or improper performance of your contractual obligations and/or the Terms and/or execution of any instruction received by the Bank from you through the Platform.
4.6. The Bank has the right to:
4.6.1. change at its sole discretion the services provided through the Platform and/or the manner and/or procedure of their provision and/or terminate the services by giving you the respective notice in person or publishing the notice on its website;
4.6.2. terminate provision of services through the Platform at its sole discretion, whether temporarily, in full or in part, in order to carry out technical maintenance of the Platform or ensure security, reliability and smooth operation of the Platform. Furthermore, this shall not be binding on the Bank, hence, the Bank shall not be held liable for the consequences if the Bank does not terminate provision of services through the Platform, whether temporarily, in full or in part, on the basis of any ground specified herein;
4.6.3. suspend or terminate use of your user profile on the Platform if it is used in violation of the Terms, or if the Bank has reasons to suspect that your user profile has been compromised. Furthermore, this shall not be binding on the Bank, hence, the Bank shall not be held liable for the consequences if the Bank does not suspend or terminate your user profile on the basis of any ground specified herein;
4.6.4. not execute or suspend execution of the orders submitted by you through the Platform or impose other limitations on the use of the Platform by you due to anti money laundering and terrorism finance combating considerations and other reasons stipulated under the Republic of Armenia laws, if the validity and/or lawfulness of such orders is not apparent.
5. Other Terms
5.1. We may place our logo or the logo of our partner, firm name and other items protected by copyright on your user profile. All such items are protected by the Armenian laws and international treaties, and their illegal use may lead to penalty sanctions against you.
5.2. You agree that in order to establish legal relationships with you and make decisions related to such legal relationships, the Bank may process, record, store and use the information, biometric data and images provided by you to the Bank, and the information about you that has become known to the Bank, as well as provide such information to the partner companies of the Bank performing technical maintenance of the Platform, if necessary, in accordance with the requirements of the Armenian laws and regulations.
5.3. Where there are legal grounds prescribed by the Armenian laws and regulations, the Bank will review and process your written application to terminate updating, deletion and/or processing of your personal data provided through the Platform, in the manner and within the time frames provided for by the laws and regulations of the Republic of Armenia and/or internal regulations of the Bank.
5.4. Where there are legal reasons prescribed by the Armenian laws and regulations, you can submit a written application to the Bank at any time to revoke your consents to receiving, processing, keeping, using your personal data by the Bank and other consents given by you in this document. You are aware that the Bank will review and process such application in the manner and within the time frames provided for by the Armenian laws and regulations and/or internal regulations of the Bank. You are also informed that in case you revoke your consent, the provision of services to you by the Bank may be limited and/or terminated.
5.5. By registering a user on the Platform and accepting (giving your consent to) the Terms, you agree that the Bank has the right to send marketing offers, notifications about new technical and software solutions and/or features of the Platform to your email address.
5.6. By registering a user on the Platform and accepting (giving your consent to) the Terms, you agree to reimburse the Bank for any losses incurred as a result of improper use of your user profile, and/or breach of the Terms, as well as in other cases specified in the Terms.
5.7. Consent to the Terms is not binding upon the Bank and does not create an obligation to provide you a loan or another service.
5.8. The Terms shall be deemed accepted once you issue your consent and/or register a user on the Platform and use the Platform via your user profile.
5.9. The Bank has the right to unilaterally amend the Terms without your additional consent, providing the relevant information by posting the Terms on the Bank’s website and/or in another manner determined by the Bank. The amended Terms will be enforced on the date specified by the Bank.
5.10. By registering a user on the Platform and accepting the Terms, you agree that the Bank may share your personal data with third parties cooperating with the Bank or make the data otherwise available to them, to ensure operation and promotion of the Platform.
5.11. In case you submit an application to book a property and/or loan application for purchase thereof, the Bank will have the right to share your data and the information concerning your loan application with the Bank’s partner developers or agencies that sell the property, to allow such parties to check the status of the loan application and plan their operations with relation to purchase and sale of the real estate.
